Terms and conditions

These terms and conditions apply to every offer made by By Dash Beauty B.V. and every order placed through our webshop.

By placing an order, the customer confirms that they have read these terms. Different arrangements are only valid when confirmed in writing by By Dash Beauty.

The contract is formed once the order has been placed through the webshop and we have confirmed it electronically. The customer is responsible for entering correct contact, payment and delivery details.

We make every effort to display product descriptions, colours, images, ingredients and other information accurately and keep them up to date.

The actual colour may differ slightly due to factors including screen settings, lighting, skin tone and undertone.

Products are available while stocks last. If an ordered product is unexpectedly unavailable, we will contact the customer and refund the relevant amount if no suitable alternative is agreed.

Obvious typographical, pricing, programming or input errors are not binding. We will inform the customer if a clear error affects an order.

All consumer prices are shown in euros and include the applicable VAT. Any shipping costs are clearly displayed before the order is completed.

Payment options available to the customer are shown at checkout. These may include iDEAL, credit card and Klarna.

If the customer chooses an external payment service such as Klarna, that service's additional terms and acceptance criteria may apply.

By Dash Beauty may change prices and promotions for future orders. A price change does not affect an order already confirmed.

We aim to process and dispatch a paid order within 1 to 2 working days , unless a different timeframe is stated on the product page or at checkout.

Orders within the Netherlands and Belgium qualify for free shipping from €35. Other current shipping costs are shown at checkout.

Once the order has been dispatched, the customer will receive a shipping confirmation with tracking where available. Stated delivery times are estimates. Carrier delays may occur.

Unless another delivery time has been agreed, we deliver within the legally applicable period at the latest. If delivery proves impossible, we will inform the customer and seek a suitable solution.

The risk of damage or loss remains with By Dash Beauty until the order is received by the customer or a third party designated by the customer.

The customer is responsible for entering a correct delivery address. Contact us immediately if an error is discovered after ordering. It may no longer be possible to change the address after processing or dispatch.

A consumer generally has the right to notify us within 14 days of receipt that they wish to withdraw from the purchase, without giving a reason.

After notifying us of withdrawal, the consumer has a further 14 days to return the product.

You can withdraw using the online withdrawal function, by email to info@bydashbeauty.com or through another clear written statement.

The consumer is responsible for the direct costs and shipping risk of a standard return. We therefore recommend tracked shipping and keeping proof of postage.

The consumer may only handle a product as necessary to establish its nature, characteristics and functioning. Any diminished value resulting from further use may be charged.

Some cosmetic products are supplied with a hygiene seal. Where it has been clearly communicated in advance that the right of withdrawal expires once this seal is broken, these products can no longer be returned after the seal has been broken.

This exception applies only where the product is unsuitable for resale after opening for health protection or hygiene reasons.

This restriction does not apply where the product is faulty, damaged or incorrectly supplied on receipt. In that case, the rules on statutory warranty and correct delivery apply.

Following a valid withdrawal, we will refund the payment received no later than 14 days after notification of withdrawal.

We may withhold the refund until we have received the product or the consumer provides proof of return, whichever occurs first.

If the entire order is withdrawn, we also refund the cost of the least expensive standard delivery option offered. For a partial return, the original shipping costs do not have to be refunded.

The refund is made using the same payment method used for the order, unless expressly agreed otherwise.

A product must meet what the consumer may reasonably expect of it. The Netherlands does not have a fixed statutory warranty period of only 14 days.

Is a product faulty, damaged, incorrectly supplied or missing? Contact us as soon as possible at info@bydashbeauty.com .

Include the order number and, where possible, clear photos of the product, packaging and shipping label.

For a justified complaint, we provide an appropriate statutory remedy free of charge, such as repair, replacement, a price reduction or a refund, depending on the circumstances.

Damage caused by misuse, improper storage, normal wear and tear, deliberate damage or failure to follow instructions is not a defect for which By Dash Beauty is responsible.

Use products only according to the supplied instructions and product information. If you have allergies or sensitivities, always check the ingredient list before use.

Stop use if irritation or an unwanted reaction occurs. Consult a doctor if symptoms are severe or persistent.

By Dash Beauty is liable for damage when and to the extent that such liability arises under the law. Nothing in these terms limits consumers' statutory rights.

To the extent permitted by law, By Dash Beauty is not liable for indirect damage arising from incorrect, careless or improper use of a product.

A limitation of liability does not apply in cases of intent or gross negligence by By Dash Beauty, or where exclusion is not permitted under mandatory law.

If By Dash Beauty is temporarily unable to perform due to circumstances beyond its reasonable control, the relevant obligations are suspended for as long as that situation continues.

Examples include serious outages, fire, government measures, strikes, transport problems, natural disasters and the failure of essential suppliers or carriers.

If performance becomes permanently impossible or takes an unreasonably long time, either party may terminate the contract for the unperformed part. Amounts already paid for undelivered products will be refunded.

All texts, product names, logos, images, designs, videos and other website content belong to By Dash Beauty or are used with permission.

This content may not be copied, published, modified, distributed or used commercially without prior written permission.

We process personal data for purposes including fulfilling orders, customer service, fraud prevention and, where consent has been given, marketing.

Do you have a complaint? Please contact info@bydashbeauty.com and include your order number where possible.

We will confirm receipt and aim to provide a substantive response within a reasonable period. If we need more time, we will let you know.

Contracts with By Dash Beauty are governed by Dutch law. This choice of law does not affect mandatory consumer protection to which a consumer is entitled in their country of residence.

Disputes will be submitted to the court with jurisdiction under the law.

We may amend these terms and conditions for future orders. The version in force when an order was placed continues to apply to that order, unless a change in the law requires otherwise.
